The "they" who make the rules fully expect O'Rourke to enforce them, but he's local and has to listen to people giving him shit so he tries to be helpful. It could be called either dereliction of duty or malfeasance in office. Just go with it and be thankful it didn't get worse... and don't for get to send some cupcakes to the next council meeting.
