In an 11-4 decision, the full U.S. 5th Circuit Court of Appeals said the so-called "protective sweep," even without a warrant, was justified because Gould had a history of violence and had threatened to kill people, including two judges, who were involved in a messy custody dispute about his daughter.

But Gould's attorney and other critics said the decision is a dramatic rollback of the Fourth Amendment's protection against unreasonable searches.
