No he's not. He's pleading "not guilty", although the attorneys will try to show that he's not guilty by reason of insanity. Virginia law doesn't allow any of that pleading "not guilty by reason of insanity" shit.

I've been living under a work-induced rock the last two weeks -- we're expecting the JCAHO reviewers next week so everythings kinda crazy. I haven't seen any coverage on the sniper trial ... if I get the time I'll have to take a peek at VA law regarding criminal responsibility, etc. Heck, if this all gets REALLY good I might even rejoin the law and psychiatry mailing lists I used to participate in.

Here is something that should piss off anti death penalty folks . I personaly think leathel injection is to nice ( and yes i have read the reports about it being painfull ) for serial killers . Bring back the giloteen , fireing squads , drawing and quartering , etc...

So, yeah. Muhammad found guilty, jury recommends death. Nation is totally underwhelmed. "No fucking duh", says area man.

You guys are living in a dream world. They won't spend a single day in jail. Here's why:

1) Virginia jury votes to convict and, subsequently, to apply the death penalty.

2) Lawyers for both defendants appeal to Virginia Court of Appeals;

2a) ... meanwhile, ACLU files summary motion to dismiss all charges against Malvo and Muhammad; claims that search of the vehicle was invalid- search warrant for car covered only the passenger compartment, and that police should have obtained a separate warrant for the trunk.

3) Fourth Federal Circuit in Richmond agrees to hear appeal. Rules that Malvo and Muhammad's civil rights were violated by the illegal search, and that the fruits of that search are inadmissable as evidence. Overturns original convictions and orders Malvo and Muhammad released.

3a) Under double jeopardy rule, Malvo and Muhammad cannot be retried in Virginia.

4) Peoples Republic of Maryland declines to prosecute after amicus curiae brief filed by NAACP accuses the State of racial bias, because a study by Amnesty International shows that the State only prosecutes serial snipers with holes cut in trunks of Chevrolets when the suspects are African-American.

5) Muhammad and Malvo file multi-million dollar lawsuit against the Commonwealth of Virginia, the Federal Bureau of Prisons, the Montgomery County Police Department and General Motors.

6) Muhammad appears on Oprah; Dr. Phil grants blanket absolution.

6a) Malvo signs multi-year endorsement contract, doing commercials with Missy Elliot for the Gap.

I think Malvo will fry too. I think his "brainwashing" defense will collapse. Malvo is fifty times smarter than Mohammed and one could actually argue that it
might have even been the other way around (as far as who "brainwashed" who). That his attys would even attempt to construct an insanity defense when the
guy is so obviously NOT insane points to how desperate his situation is.

Malvo is one evil bastard. The jury will see that, the jury will see all the comments, writings and drawings he said/made while in custody and the jury will see
this man as a remorseless, cold-blooded murderer and they will sentence him to death. The jury hesitated sentencing Mohammed to death but his lack of remorse
swayed them. They will not, imho, hesitate with Malvo as he has NO redeeming qualities whatsoever.

I'm not a death penalty advocate as I do not have the nads to pull the switch. But I am a HUGE hypocrite in that regard as I feel they should both die for their crimes and their lack of remorse for the victims and the victims' families.
