Yeah...there are lots of dicks all over the place.

It is true that the US has a more letigenous(sp?) society than most though. Australia is becoming more and more alike though, so don't worry. You'll be in good company soon. ;)

This is what I was thinking. My ex sis-in-law practiced law in the US and now in NZ and she has indicated that frivolous lawsuits don't happen there. I'm not sure about the laws that govern this, but my head is filled with glee at imagining a judge saying "What? Oh shut the fuck up and get out of my courtroom."

We have a more litigious society than many others because we operate under the rule of law (as opposed to many countries). Society grows, becomes more complex, laws become more complex -- and so do the abuses. It's like -- you can't have good without evil.

OK, well this is the type of stupid lawsuit that has started happening over here and about which I am opposed.

A woman went to the pub, got pissed (after already being stoned at home) and when she walked out of the pub, she tripped over a speed bump in her drunken stupor and hurt her back. The pub had to pay her $250K because the stipes on the speedbump weren't white enough.

I know all the details because it happened to be the mother of an ex-boyfriend. She was just a trog and that money would have been better off going to charity than for her to spend on drugs and booze and cigarettes. Her 'sore back' didn't stop her from enjoying all those things still. Her lifestyle was not affected one little bit.

I realize what you're saying cloud, but it's just silly to clog up courtrooms with shit like this. In the end, if anything, the pub should have been ordered to pay medical costs and paint the speedbumps. Not give this woman $250k to smoke up. That's the problem. A lot of the people that enter into these lawsuits do it for all the wrong reasons.

Frivolous law suites will be the one of the many nails in the coffin of this country.

This is one of the things that spook me about the internet; it seems that any comment or complaint is potential for liable.

Most frivolous lawsuits simply get dismissed, and there are heavy penalties imposed on attorneys who are found to have filed them. There will always be people who abuse the system, but there are also checks and balances in place to address it. People can try to sue for anything they want--achieving a desired result is a different story.

Reminds me of a news story I saw when in Japan. A 55 year old former teacher was being released from prison. He had been working at a reform school/sailing academy for wayward youth, but had beaten to death not one but two students (and two others were missing without trace).
He got five years in prison.
As he was being released, he said words to the effect of "I did nothing wrong. Physical punishment is educational. I am looking forward to returning to my position at the academy." [my emphasis.] :eek:

Doesn't your bill of rights say that you have the right to be kept safe from harm while in the custody of the state?
Doesn't that mean that every single time someone is assaulted or raped or even exposed to disease while in prison, their civil rights have been violated? And the relevant authorities are criminally responsible for it, a la the Rodney King beat-down?

Uh, what? No, I don't think it says that. It says no cruel and unusual punishment may be inflicted, but that's not what you're describing.

There was a bikie brawl in March at an airport in Sydney, as members of the Hell's Angels and Comancheros clashed after - ironically - retuning on the same flight from what was supposed to be some kind of peace conference. One man was killed.

This chap, a Hell's Angel, was in custody for a long time, but was finally released on bail, on the condition that he not associate with any other Hell's Angels.

To make sure there was no confusion, the cops sent him a list of the people he was not allowed to hang out with. Well, that was the idea.

They sent him a list of the names and home addresses of 46 members of the COMANCHEROS instead. :smack:

Well, maybe it says both, you know. I think it says quite a few things.

I'm going on what I remember from the second Rodney King trial. After the poice were acquitted of assault, they were charged with the different crime of violating his civil rights by failing to ensure he was kept safe from harm etc.

I suppose I should look it up. Too lazy.

Now Brazilian investigators say the popular presenter's knack for being first at a murder scene is more than just a coincidence.

State police intelligence chief Thomaz Vasconcelos says it is believed the popular TV host ordered the crimes be committed.

"In truth, he went as a far as creating facts and ordering that crimes be committed to generate news for the program," he said.

Souza is a former cop who was expelled from Brazil's civil police force before turning to reality television and then politics, where he was the most voted-for candidate in the last elections held in the state of Amazonas.

But it all began to unravel last October when the television host's former security guard was arrested and accused of at least five murders.

The security guard reportedly confessed, but said he had been ordered to kill by his employer and his employer's son, Rafael Souza.

And in a dramatic twist worthy of its own television storyline, the allegations do not end there.

Amazonas state prosecutor Fabio Monteiro says Souza is also accused of running a drug trafficking network of former police officers.

And he believes the murders served not only to boost his TV ratings, but also to eliminate rival drug lords.

"I have pressed charges against him in court for carrying weapons illegally and forming a gang," Mr Monteiro said.


'Framed'

Souza's lawyer Francisco Balieiro says his client vehemently denies the accusations and believes he and his son have been set up.

"Up to now, no-one has presented any technical evidence - none," he said.

The defence lawyer says his client has accused political opponents of trying to discredit him.

"All the investigations made by the public ministry and the police have so far not been able to present any proof of any kind," he said.

Souza's show is no longer on air and his son is in jail. But despite being under investigation, he remains free due to a quirk in the system which gives him immunity because he is a politician.
