The Supreme Court is down one, meaning 4 to 4 ties are not only possible, but probable. Now the Republicans want to keep it that way as long as they can, making the court as constipated as Congress.

When the Supreme Court is tied 4-4, the lower court's ruling is upheld. It's a little ironic, because most of the lower circuit courts are fairly liberal.

If there's anything important hanging in the balance, I'm sure that situation can be resolved by another one dying. :ninja:
