16th amendment still stands

From MSNBC: CONCORD, N.H. - U.S. marshals posing as supporters arrested convicted tax-evaders Ed and Elaine Brown at their rural, fortress-like home, the head marshal said Friday.

“They invited us in, and we escorted them out,” U.S. Marshal Stephen Monier said, releasing the first details of Thursday night’s arrests.

The Browns were turned over to federal corrections officials to serve prison terms of 63 months. They were convicted in January of scheming to avoid federal income taxes by hiding $1.9 million of income between 1996 and 2003 and were sentenced in April.

The couple claims the federal income tax is not legitimate. Their argument — repeatedly rejected by courts — is that no law authorizes the federal income tax and that the 1913 constitutional amendment permitting it was never properly ratified.


Radar will be most disappointed, I'm sure.

16th Amendment and Ratification

The courts have never ruled the 16th Amendment wasn't properly ratified. The courts have ruled they are precluded from addressing the issue.

There is current litigation before the Federal District Court in Chicago regarding this issue. The case is United States v. Benson, Case No. 1:04-cv-07403 (N.D.Ill.E.D. 2004). Complete details of the case, including the facts of non-ratification and the court's refusal to hear the issue are on my website. The link is available on my profile.

Yeah. If it weren't for the Third Amendment, you'd have to pay taxes to have the soldier billeted in your dwelling too. This would be a bit like getting a bill for the firing squad's bullets after they shoot your relative. (A favorite insult of totalitarianisms everywhere.)

There have been some cases recently ( 3 months or so ) that have found non-filers and "tax cheats" completely innocent in court.

I do believe that the government will arrest and jail you for not filing and paying their income tax, but I'm very skeptical as to how they might do that with the way that the "laws" are written and the rights that you have to give up just to comply.
