I don't make this stuff up, people.

OK, so they had a fight about his alcoholism. She didn't make dinner, and didn't want sex, and he wants to beat her up, so she defended herself and got his sac in a twist. He DECIDES not to go to the doctor and dies. She's charged for murder. Tell me I'm not the only one who sees something wrong with this.

Interesting piece OC. Seems strange in several ways. The murder rap as you mentioned, him "trying" to beat her, the reasoning behind him "trying" to beat her and him allowing access to his balls.....*during a confrontation*.
I can think of a few couples that not fixing dinner and sleeping/having sex might be doing him a favor. |

So OC, if a man severely beats and rapes a woman, and she doesn't go to the hospital because she's embarassed, and she ends up dying a few days later, is the man blameless? I suppose it's her fault because she decided not to go to the hospital?
I'm not saying this guy was blameless or maybe didn't deserve a good ball-twist, but murder is murder. |

A very large, drunk, aggressive man corners me in a booth in Denny's. A man about 100 pounds bigger and one full foot taller. He then threatens me, spits in my face, and then punch me in the nose. I grab the butter knife to defend myself. He dies in the ensuing melee. I am then accused of murder? Yes, according to the law. I used a deadly instrument. Murder is murder.

He died, not because she stabbed him, but because HE REFUSED TO GO TO THE DOCTOR. Whether she is guilty of hurting the man is not in question here. What is in question is that she is being tried for MURDER because her husband REFUSED to seek medical treatment. It's not even close to the same thing, tw.
If he had gone to the doctor and died, I wouldn't have a problem with her charge of murder, and would hope she would be able to use self defense. But he DIDN'T GO TO THE DOCTOR. So use a different example, tw. One that is similar to the situation. So in your example, yes, you should be tried for murder, although it was self defense. If you stabbed him with a butter knife and he wandered off, then died 3 days later because he refused to go to a doctor, should you be charged for murder? Absolutely not.

He was the agressor. You acted in defense of your life. You had, at that time, the reasonable expectation of and fear of death if you don't do something to stop his attack. The second he breaks off his attack, though, everything changes. Now ... you WOULD have murdered him if ... after punching you in the nose he is satisfied with the amount of blood pouring out of your face and he ends his assault. He goes back to his table and enjoys the remainder of his chicken fried steak and eggs with his cronies. You, on the other hand, are no longer enjoying your Grand Slam breakfast. In fact, you are so incensed by his behavior that you decide that something must be done about it. Instead of calling the local constabulary, you decide to deal with the problem yourself. You go out to the parking lot, and find a spot with a good view of the door. When he emerges from the restaurant you shoot him with a crossbow bolt as he turns to talk to one of his buds, which passes through his ears. In his last instants of life, he is reminded of Steve Martin, back when he was funny. NOW you have murdered him. You are no longer acting in defense of your life.
