I believe its called being an accessory to murder if you know in advance that someone is planning to kill someone, and do nothing to prevent it or alert the authorities. This is what the ax murderer did. He knew his bro was going to kill that 19 year old child (she was SUCH a pretty little thing

) and sat on his hands and did nothing. That is an actual crime and has nothing to do with constitutional rights.
