Contrary to what some might lead you to believe, under the new standard set by the Supreme Court, it would still be illegal for three teenagers to lure a fourth to an isolated spot, kill, and rob him.

True, but now the courts get to rehash the life v juvenile life issue and whether it's cruel and unusual for states with 'life means life' statutes is a valid way to deal with someone for the next 60 years.

If capital punishment is to deter crime, well the difference between capital punishment verses jail must be understood by the perpetrator. Kids get shot and are complete surprised that it hurts. If they don't even understand people actually die - or suffer pain - when shot; then how is capital punishment suppose to be any more effective than jail?

Yes, differences of brains between teenagers and adults is that significant.

Well, we could bring back the death penalty as a follow up to flogging.

If flogging doesn't instill a fear of pain or consequences, nothing will.

That way if they fuck up sufficiently again, they will be in a position to understand the conswquences.
