Well, a judge has ruled that even people who vote against the recall can still vote for the new Governor.

So people can say "screw you" to the guys who bankkrolled this thing by electing Flynt as the new governor.

BTW, since Gray Davis would no longer be governor if he is recalled, what is to prevent him from putting his name on the ballot with the recall and being re-elected.

He can't. Because the recall question and the potential replacement will be on the same ballot, Davis is not permitted to both fight recall and run for office. That's what one of the lost appeals was about.

I was curious about this, as well, and it took a lot of digging to find this one artical which addressed this question, so if anyone has a more definitive source, I wouldn't mind reading it.

Here's how it works, and I meant to reply to this earlier but I was busy:

People are given a ballot which basically has two questions. The first is "Should Gray Davis be governor?"

The second is "If not, then who?"

And they select from a list. But yeah, he's not allowed to be on it.
